Can a
juvenile minor go to jail for an alcohol related driving offense?
Yes. The
Juvenile Justice Code classifies first-offense DUI and other
alcohol-related driving offenses as delinquent conduct
indicating a need for supervision. What this means is that a
juvenile convicted of first offense DUI can be placed on
probation or committed to the Texas Youth Commission for
confinement and rehabilitation. Furthermore, a minor above the
age of 17 can be sentenced to up to 180 days jail on the third
conviction for DUI or the first conviction for DWI.
Interestingly, however, a police officer who charges a minor
with DUI is not required to take the minor into police custody,
but may merely issue the minor with a citation and court
summons.
